Terms of Service

1. Who can use Homewise

You must be at least 18 years old and legally capable of entering a contract under Indian law to use the Service. By using the Service, you confirm that you meet these requirements.

2. Your account

You sign in using magic-link email authentication. You are responsible for keeping your email inbox secure and for all activity that happens under your account. Tell us immediately at support@homewiseapp.in if you suspect unauthorised access.

Designer accounts are provisioned only by Homewise; you may not use a designer account unless we invited you.

3. What Homewise does

Homewise is an AI-powered interior planning tool for Indian homeowners. Based on the photos, dimensions, style preferences, and other inputs you supply, the Service produces:

• Moodboards and AI-generated renders of your room.
• Material and finish selections, layout suggestions, and cost estimates.
• Optionally, human designer review and revisions (Pro tier).

4. Tiers, pricing, and free credits

Homewise is offered in tiered plans (currently Basic, Standard, and Pro), each with different features, number of included revisions, and price. Current prices and inclusions are shown in the Service at the point of purchase and may change from time to time. Changes will not affect projects you have already paid for.

We may offer promotional credits from time to time (for example, one free Basic render per email at launch). Promotional credits are non-transferable, have no cash value, and are subject to the specific promotion’s terms. We may withdraw or modify promotions at any time.

Prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

5. Payments

Payments are processed by a third-party payment gateway. By making a payment you agree to that gateway’s terms. Homewise does not store your card, UPI, or bank credentials.

6. No refunds

The Service delivers AI-generated digital goods. Once a render, moodboard, or design output has been generated for you, all fees paid are non-refundable. This includes cases where you are dissatisfied with the style, materials, layout, or aesthetic outcome of a generated design, or where you change your mind after paying.

If a generation fails on our end and we cannot deliver any output for a paid project (for example, a persistent technical fault we cannot resolve), we will either regenerate the project at no cost or, at our discretion, provide a credit toward a future project. Nothing in this section limits any rights you have that cannot be excluded under the Consumer Protection Act, 2019 or other applicable Indian law.

7. Your content and licence to Homewise

The room photos, dimensions, style choices, and other content you upload (“Your Content”) remain yours. You represent that you have all necessary rights to upload them and that they do not infringe anyone else’s rights.

You grant Homewise a worldwide, royalty-free, non-exclusive licence to host, store, transmit, process (including through third-party AI providers), and display Your Content solely to operate and provide the Service to you.

We may also use anonymised, AI-generated renders (not your original room photos) for portfolio and marketing purposes, as described in the Privacy Policy. You can opt out at any time by writing to support@homewiseapp.in.

8. Generated designs

Subject to your payment of applicable fees, you receive a personal, non-exclusive, non-transferable licence to use the moodboards, renders, materials lists, and other outputs generated for you in connection with your own home. You may share them with your contractor, architect, or other service providers for the purpose of executing the design.

You may not:

• Resell or sublicense the outputs as your own design product.
• Use them to train competing AI models.
• Represent AI-generated renders as photographs of real built spaces.

9. Acceptable use

You agree not to:

• Upload content that is illegal, infringing, obscene, hateful, or violates anyone’s privacy.
• Upload photos of people or spaces without appropriate consent.
• Attempt to reverse engineer, scrape, or overload the Service.
• Use the Service to build a competing product or to systematically extract generation outputs.
• Interfere with security features, rate limits, or other users’ use.
• Use automated tools or bots to interact with the Service.

We may suspend or terminate accounts that violate these rules and remove content without notice where necessary.

10. AI-generated content: important disclaimers

• Illustrative, not construction drawings. Renders, moodboards, and layouts are visual concepts. They are not architectural drawings, structural certificates, or engineering documents and must not be used as such.
• Cost estimates are indicative. Materials, labour, and execution costs vary by city, vendor, and site condition. Prices shown are estimates and not quotations.
• Site conditions may differ. The final built result depends on your contractor, site measurements, plumbing, electricals, and other factors we cannot assess remotely. Verify feasibility on site before execution.
• AI can be inaccurate. Generated content may occasionally contain visual artifacts, dimensional inconsistencies, or material suggestions that are impractical. Review outputs carefully before acting.

11. Designer review (Pro tier)

On the Pro tier, a designer approved by Homewise reviews your project and provides feedback within stated service levels. Designers are independent professionals engaged by Homewise; their advice is a professional opinion, not a guarantee of any specific outcome, timeline, or cost of execution.

12. Third-party services

The Service depends on third-party providers, including OpenAI, Anthropic, Supabase, and payment gateways. We are not responsible for their outages, errors, or changes to their services beyond our reasonable control.

13. Intellectual property

The Homewise name, logo, website, application, prompts, pipelines, and underlying software are owned by Homewise and protected by Indian and international intellectual property laws. Except for the licence granted to you in Section 8, nothing in these Terms transfers any IP rights to you.

14. Suspension and termination

You may stop using the Service and delete your account at any time from your account settings, or by writing to support@homewiseapp.in.

We may suspend or terminate your access if you breach these Terms, if we reasonably suspect fraud or abuse, or if we are required to do so by law. Sections that by their nature should survive termination (including licences you granted, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that any specific design, cost estimate, material, or outcome will meet your expectations, suit your site, or be free of defects.

16. Limitation of liability

To the maximum extent permitted by law, Homewise’s total aggregate liability arising out of or in connection with the Service or these Terms is limited to the total amount you paid to Homewise for the project giving rise to the claim, or INR 5,000, whichever is higher.

Homewise will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, loss of business, loss of data, or costs of substitute goods or services, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

17. Indemnity

You agree to indemnify and hold harmless Homewise and its personnel from any claim, loss, or expense arising from (a) content you upload, (b) your breach of these Terms, or (c) your misuse of the outputs generated for you.

18. Changes to the Service or Terms

We may update the Service, add or remove features, and revise these Terms. If we make material changes to the Terms, we will notify you by email or through an in-app notice before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

19. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer protection rights available to you, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
